RackWorks LLC Acceptable Use Policy (AUP) Effective Date: June 1, 2026 Last Updated: June 1, 2026 1. Purpose The purpose of this Acceptable Use Policy ("AUP") is to define the prohibited conduct for all users of RackWorks LLC's services ("Services") to ensure the integrity, security, and availability of our network and infrastructure, and to comply with all applicable laws and regulations. By using RackWorks LLC's Services, you agree to comply with this AUP. Violation of this AUP constitutes a material breach of the Terms of Service and may result in suspension or termination of Services without refund. 2. Prohibited Uses You may not use the Services to engage in any activity that is unlawful, harmful, offensive, or that interferes with or disrupts the Services, RackWorks LLC's network, or other customers' use of Services. Specifically prohibited activities include, but are not limited to: 2.1 Illegal Activities Use of Services to violate any applicable law, statute, ordinance, or regulation, including but not limited to those relating to fraud, money laundering, intellectual property infringement, child exploitation, and trafficking of illegal goods or services. 2.2 Security Violations Unauthorized access, hacking, or intrusion attempts against any system or network, including but not limited to port scanning, vulnerability probing, password cracking, or exploitation of security flaws. Distribution or facilitation of malware, viruses, worms, trojans, ransomware, spyware, or any malicious code. Participation in or facilitation of Distributed Denial of Service (DDoS) attacks or network flooding. 2.3 Spam and Unsolicited Communications Sending unsolicited bulk email ("spam"), unsolicited commercial communications, phishing attempts, or other deceptive messaging practices. Operating open mail relays, open proxies, or similar services that permit unauthorized use. 2.4 Intellectual Property Violations Hosting, storing, distributing, or linking to copyrighted content, trademarks, trade secrets, or other proprietary materials without proper authorization. Facilitating unauthorized sharing or distribution of pirated software, media, or data. 2.5 Harmful Content Hosting or distribution of content that is obscene, defamatory, libelous, abusive, threatening, hateful, racially or ethnically offensive, or otherwise objectionable under applicable laws. Hosting or distribution of child pornography or materials that exploit minors. 2.6 Abuse of Resources Excessive consumption of bandwidth, CPU, memory, or other resources that degrade RackWorks LLC's Services or impact other customers. Running cryptocurrency mining operations or other resource-intensive applications without explicit prior written consent. 2.7 Privacy Violations Unauthorized collection, use, or disclosure of personal data of third parties. Intercepting or monitoring communications without consent. 2.8 Bandwidth Allowance and Throttling Policy Each service plan includes a monthly outbound transfer allowance as stated at the time of purchase. When a service exhausts its monthly transfer allowance, outbound (egress) traffic will be throttled to 10 Mbps for the remainder of the billing cycle. Inbound (ingress) traffic is unmetered and is not subject to throttling. Full speed is restored automatically at the start of each new billing cycle. Customers may purchase additional transfer capacity at any time from the client portal to restore full-speed access before the cycle resets. RackWorks LLC reserves the right to adjust throttle thresholds with reasonable notice. 3. Monitoring and Enforcement 3.1 RackWorks LLC reserves the right, but is not obligated, to monitor all traffic and content to ensure compliance with this AUP. 3.2 RackWorks LLC may investigate any suspected violation and may request additional information from you to verify compliance. 3.3 In cases of suspected abuse, RackWorks LLC may, at its sole discretion: Suspend or terminate your Services temporarily or permanently. Disable access to offending content or systems. Report incidents to law enforcement or appropriate authorities. 3.4 RackWorks LLC will not be liable for any damages resulting from such enforcement actions. 4. Reporting Abuse If you believe someone is violating this AUP, please report it promptly to abuse@rackworks.net with detailed information, including evidence if possible. 5. Appeals If your Service is suspended or terminated due to alleged AUP violations, you may submit a written appeal to legal@rackworks.net within 7 calendar days. RackWorks LLC reserves the right to accept or reject appeals at its sole discretion. 6. Amendments RackWorks LLC may update this AUP at any time by posting the revised version at rackworks.net. Your continued use of the Services constitutes acceptance of the updated AUP. By using RackWorks LLC's Services, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.
